Brian Caufield began his legal career at the National Labor Relations Board and has practiced in the area of traditional labor relations for more than 20 years.
Brian spent time as a neutral with Region 22 of the National Labor Relations Board (“NLRB”) in Newark, New Jersey. His time at the NLRB included service as President of Local 22 of the NLRB Union, liaison between the state bar and labor community for the annual Region 22 labor law conference, and a detail assignment to Washington, DC to work in the Solicitor’s Office—the Chief Legal Advisor to Members of the NLRB.
He moved to the management side of the labor relations practice in his role with Fox Rothschild, a nationwide law firm. At Fox, he represented clients in several industries including education, construction, trucking, hospitality, and service. While there, Brian built upon his relationships at the NLRB to best serve his clients, their employees, and the labor unions with which they partnered.
Brian ventured West to Oregon in 2012 and transitioned to the public sector of the practice within the Office of General Counsel of the Oregon University System. There, and currently, Brian represents Oregon's public universities in all aspects of labor relations.
Brian is a graduate of Seton Hall University and Touro Law Center, and a little known fact about his is that he worked with the public relations department of the NBA’s New Jersey (now Brooklyn) Nets covering the visiting team locker rooms where he encountered the likes of Michael Jordan, Larry Bird, and Shaquille O’Neal.
Interpreting and implementing a labor contract can be challenging, but not doing so accurately can have significant consequences. Understanding how each party intended the language to be applied and how it actually is applied is essential to providing reasoned advice. Whether you need daily advice or seek a structural change in your business, be sure to retain the right person.
It's critical to the success of negotiations to understand the unique interests of your business and the union representing your employees. Only then can a negotiations and communications plan be developed and implemented. From the first planning meeting to training staff on working within the labor contract, let an experienced negotiator lead you.
Whether your lawyer has been involved from the start of the grievance process or hired just for the arbitration, they must immerse themselves into the facts as if they lived them. Knowledge of arbitrators and relationships with the union or its counsel are equally important, if not more, to assessing risk and achieving success. Trust an accomplished professional in this area.
More often than not, employers are taken aback when their employees unionize. Positive employee relations can mitigate this, but when a petition is filed quick action is required to comply with Agency deadlines. Consider counsel who has engaged in countless organizing drives, and elections from both inside the Agency and out.
Receiving an unfair labor practice charge can be unsettling, particularly if you believe you embarked on a path that was legal. Understanding the nuances to navigating a case at the NLRB or state labor board is difficult. Choose a practitioner with the right experience and relationships to represent you in this ever-change arena.
